Welcome to HKSKINCART (the “Website”). By browsing this Website, registering an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions (“Terms”). If you do not agree with any part of these Terms, please stop using the Website and do not place any orders.

These Terms apply to your use of the Website, and to all orders submitted through the Website and related services. If there is any inconsistency between these Terms and other policies on the Website (including the Privacy Policy, Return & Refund Policy, and Delivery Policy), the relevant policy page shall prevail.

1. Website Use & Accounts

1. You may place orders as a guest or as a registered member.
2. You agree to provide true, accurate, and complete information (including name, phone number, email address, delivery address, etc.) and to promptly update such information if it changes.
3. You are responsible for any delivery delays, returns, loss, additional shipping fees, or other losses arising from incomplete or incorrect information provided by you.
4. If we reasonably suspect fraud, abuse of promotions, malicious ordering, or other dishonest conduct, we reserve the right to refuse transactions, cancel orders, or restrict/terminate account access.

2. Product Information, Images & Version Differences

1. We make reasonable efforts to ensure product information (including ingredients, specifications, directions, origin, packaging images, etc.) is accurate. However, due to brand re-packaging, batch variations, supplier updates, or translation differences, the actual product may differ slightly from the page description/images.
2. If you have concerns about ingredients or sensitivity risks, please check the brand’s official labeling or contact us before purchase. You should make your own judgment on suitability based on your personal circumstances.
3. Content on the Website is provided for general product information only and does not constitute medical advice.

3. Pricing, Payment & Promotions

1. Product prices, shipping fees, promotion conditions, and available payment methods are subject to what is shown at checkout.
2. We reserve the right to adjust prices and promotions without prior notice due to costs, exchange rates, supply conditions, or promotional campaigns.
3. Discount codes / gifts / spending-threshold offers are subject to stated terms and validity periods. Unless otherwise stated, they are not redeemable for cash and may not be combined with other offers.
4. Successful payment does not necessarily mean an order is accepted or that stock is guaranteed (see Section 4).

4. Order Acceptance, Out-of-Stock, Discontinuation & Cancellation

1. After you place an order, we will send a system notification/email acknowledging receipt. An order is accepted only when we issue a dispatch confirmation or when the order is actually dispatched.
2. We may cancel an order or make reasonable adjustments (including refunds, suggesting replacements, or split shipping) in circumstances including but not limited to: out-of-stock, discontinued/unavailable items, supply exceptions; pricing/stock/system errors; incomplete payment or high-risk transactions (suspected fraud); logistics restrictions or force majeure preventing fulfillment.
3. If an order is cancelled after payment, we will arrange a refund via the original payment method or other reasonable means. The actual time for funds to be credited depends on the payment platform/bank processing.

5. Delivery & Risk

1. Dispatch timelines, delivery methods, shipping fees, and free-shipping thresholds are governed by our Delivery Policy.
2. Transit times are for reference only and may be delayed due to customs, flights, weather, holidays, or courier arrangements.
3. To the extent permitted by law, once goods are handed over to the courier/carrier, delivery risks and subsequent handling generally follow the courier’s terms and our Delivery Policy. We will make reasonable efforts to assist with inquiries or follow-ups, but we do not guarantee compensation or successful claims in all cases.

6. Returns, Exchanges & Refunds

Return/exchange eligibility, time limits, evidence requirements, and refund arrangements are governed by our Return & Refund Policy. If there is any inconsistency between these Terms and the Return & Refund Policy, the Return & Refund Policy shall prevail.

7. Privacy & Personal Data

Our collection, use, retention of personal data, and your related rights are governed by our Privacy Policy. If there is any inconsistency between these Terms and the Privacy Policy, the Privacy Policy shall prevail.

8. Intellectual Property

All content on the Website (including but not limited to text, images, design, trademarks, layout, and code) is protected by intellectual property laws. No part may be copied, reproduced, modified, distributed, or used for commercial purposes without our prior written consent.

9. Prohibited Conduct

• Interfering with the normal operation of the Website or attempting unauthorized access to systems
• Posting or transmitting unlawful, infringing, defamatory, harassing, obscene, or otherwise inappropriate content
• Fraud, abuse of promotions, malicious ordering, malicious refund/claim attempts, or other dishonest conduct

If you breach these Terms, we may restrict/terminate your access and refuse service, and we reserve all rights to take further action.

10. Limitation of Liability

1. To the maximum extent permitted by law, we are not liable for any indirect, incidental, punitive, or consequential losses (including but not limited to loss of profits, loss of goodwill, or loss of data).
2. Where liability is required by law, our total maximum liability relating to an order is limited to the amount you actually paid for the goods in that order (unless otherwise required by law).
3. Any damage arising from improper use of products, failure to follow product instructions, individual differences, or allergic reactions shall be borne by you.

11. Force Majeure

We are not responsible for delay or failure to perform due to force majeure events (including but not limited to natural disasters, fire, pandemics, government measures, war, strikes, logistics interruption, or system failures). In such cases, we may reasonably postpone performance, reschedule dispatch, or cancel the order and refund.

12. Updates to These Terms

We may update these Terms from time to time. Updates take effect immediately upon posting on the Website. By continuing to use the Website or placing orders after updates are posted, you agree to the updated Terms.

13. Governing Law

These Terms of Service and any other agreements we provide to you are governed by the laws of Hong Kong, China, and shall be construed in accordance with the laws of Hong Kong.
